What is a temporary exemption notice (TEN)?

If you intend to take steps to make your property no longer licensable, you can apply for a temporary exemption notice (TEN).

If granted, the property won’t need a license for three months from the date the TEN is served. In exceptional cases, you may request a second and final TEN for an additional three months.

A TEN may be granted in the following cases:

  • The property is sold subject to contract.
  • Tenants have given notice of their intention to vacate the property.

What happens if a licence-holder passes away?

If the licence-holder passes away while the licence is in force, the licence ends immediately. From the date of death, the property is treated as if a temporary exemption notice has been granted for three months.

At the end of this period, a second exemption can be granted for a further three months if requested, but the maximum exemption period is six months from the date of death.
