This includes information relating to:

- Applicants affected by local land charges
- People associated with planning applications and planning agreements
- Grant recipients where a charge is registered against a property

We collect information from relevant council departments to maintain the Local Land Charges Register.
The information may include details relating to:
- Community Infrastructure Levy charges
- Grants, including Disabled Facilities Grants
- Works in Default
- Planning applications
- Planning agreements
We only collect and process information necessary to maintain the register and fulfil our statutory responsibilities.
Where we get your information from
Information is collected from internal Portsmouth City Council services that create, manage or administer local land charges.
The Land Charges Team receives information from the relevant service areas once it has been processed and approved for inclusion on the register.

Portsmouth City Council uses personal information to:
- Update and maintain the Local Land Charges Register
- Record statutory land charges against properties
- Ensure the register remains accurate and up to date
- Meet our legal obligations relating to local land charges

The Council processes personal information as part of carrying out its statutory responsibilities relating to Local Land Charges.
The lawful basis for processing this information is:
- Article 6(1)(c) UK GDPR – Legal obligation
- Article 6(1)(e) UK GDPR – Public task
Who we share your information with
Portsmouth City Council has entered into an agreement with HM Land Registry to transfer responsibility for Local Land Charges statutory searches from local government to HM Land Registry in accordance with the Infrastructure Act 2015.
As of 28 April 2022, Local Land Charges searches have been provided by HM Land Registry using data supplied by Portsmouth City Council.
Information is transferred securely to HM Land Registry for this purpose.

Where organisations process information on behalf of Portsmouth City Council, they are required to act only on our instructions and apply appropriate security measures to protect personal information.
How long we keep your information
Information remains on the Local Land Charges Register for as long as the charge remains current and relevant to the property.
When a charge is no longer current, it is removed from the register in accordance with applicable legislation and procedures.
How we keep your information secure
Information held on the Local Land Charges Register is stored securely and controlled by Portsmouth City Council.
Access to update or amend the register is restricted to authorised Land Charges staff.
Staff are trained before being granted access to the system.
The Council uses appropriate technical and organisational measures to protect personal information.
Your data protection rights
Under UK GDPR, you have rights in relation to your personal information, including:
- The right to access your personal information
- The right to request correction of inaccurate information
- The right to request restriction of processing in certain circumstances
