Frequently asked questions
Last updated: 18 March 2009 15:46 UKGenerally speaking, an application for Building Regulation Approval is required for most types of development. The following commonly asked questions, with their answers, may help you to decide whether any works you propose to carry out need approval. Do I need Building Regulation Approval to...
- build an extension to my property?
Yes, unless the extension is exempt.
- convert my loft space into a room?
Yes.
- convert my garage into a habitable room?
Yes.
- make internal alterations to my property?
Yes, if the alterations are of a structural nature or could affect the means of escape in case of fire.
- install cavity insulation into my property?
Yes, but if you use an approved installer they will usually make the application on your behalf, so check with them first.
- construct a detached garage?
No, provided the floor area does not exceed 30m and it is either, sited 1 metre or more from the boundary, or constructed of substantially non-combustible material. Small garages (less than 15m2 need not comply with the above. However any garage attached to the house will require approval.
- construct a car-port?
No, provided its floor area is less than 30m2 and is open on at least two sides.
- provide a covered yard or covered way to my house?
No, provided its floor area is less than 30m2
- construct a porch?
No, provided its floor area is less than 30m2 and any glazing in windows and doors complies with Requirement N1 of the Regulations. However the provision of a WC within any exempt structure would require an application for the new drainage.
- construct a conservatory?
No, provided its floor area is less than 30m2 and its roof is glazed with translucent material and any glazing in windows and doors complies with Requirement N1. However, separation (such as a patio or French doors) must be maintained between the conservatory and existing property.
N.B. The provision of a WC within any exempt structure would require an application for the new drainage
- construct buildings such as a shed or greenhouse?
No, provided they are detached and contain no sleeping accommodation. The exemption rules are the same as for garages. (See question 6 above)
- install replacement windows to my house?
Yes, all replacement windows to a habitable room must be energy efficient, these should be fitted by a member of FENSA or a Building Regulation application would be required. If a larger opening is required then a structural alteration will take place and approval will be required. Where a different style of opening is used you should check that the window is not required for fire escape purposes, and that the opening size and positioning will remain satisfactory.
- carry out repairs to my house?
No, if the repairs are of a minor nature and you are replacing like for like. This includes replacing the felt on a flat roof, re-pointing or replacing a small area of brickwork. Yes, if the covering of the roof is replaced with heavier or lighter materials that require the strengthening, or additional bracing, of the roof structure.
- convert my house into flats?
Yes.
- underpin my house?
Yes.
- install fittings and appliances within my house?
Yes, if it involves new drainage or plumbing, certain gas/water heating appliances or an un-vented hot water storage system. N.B. Any work involving a gas installation should be carried out by a member of CORGI.
- carry out any electrical work?
From 1 January 2005 the design, installation, inspection and testing of electrical installations will be controlled under the Building Regulations: see Part P Guidance.
- obtain Approval for work that has already been carried out?
Yes, if the work was commenced after 11 November 1985: see Regularisation.
