What are the legal requirements for Private Hire Drivers?

There are many different laws affecting drivers but the main Act of Parliament covering the licensing of Private Hire Drivers is contained in Part II, Local Government (Miscellaneous Provisions) Act 1976. You may inspect the act in our office.

This Act says we cannot grant you a licence unless we are satisfied that:

  1. You are a 'fit and proper' person to hold a driver's licence.
  2. You currently hold (and have held) a full driving licence issued by DVLA (or a European Community Licence) for a period of 12 months before making your application to us.
  3. You are 18 or over.
  4. You have been honest in supplying information to us and must not, under any circumstances, make a false statement at any time to obtain your licence. This is a serious offence.
